On Thursday, November 16, 2023, Santa Clara Superior Court Judge Amber Rosen dismissed the Hindu American Foundation’s Motion to Intervene. HAF filed the motion in January 2023 in the case of California Department of Fair Employment and Housing v. Cisco Systems for injunctive relief to prevent the state’s overreach and violation of Hindu American rights under the First and Fourteenth Amendment and California’s Unruh Civil Rights Act. The Foundation’s legal team announced that it will appeal the ruling.

 

HAF’s Managing Director, Samir Kalra, Esq. stated: 

 

“While the Court expressed its concerns about the California Civil Rights Department’s decision to include defamatory language conflating caste and Hindu teachings, it declined HAF’s Motion to Intervene in the case in order to defend Hindu American community against these unprecedented attacks.  

Fights for civil rights are rarely won with the first battle and in the American legal system, David never fells Goliath with a single stone.  

To that end, HAF will appeal the ruling and explain to the California Court of Appeal why HAF has a legal and moral right to a seat at the table when the California state government attacks our fundamental rights.  And HAF will be there for the battles to come to defend the rights and reputation of the Hindu American community.”
